1. Using this site

By browsing this website, submitting a form or otherwise dealing with us, you agree to these terms. If you are doing so on behalf of a company, you are confirming that you are authorised to accept them for that company. If you do not agree with something here, please do not use the site.

These terms cover the website and the application process. If you go on to sign a financing agreement with us or with a funding partner, that agreement governs the financing itself and takes priority over anything on this page.

2. What Modulyz does

We arrange commercial financing for business owners, including equipment leasing, working capital and term structures. Depending on the structure and the credit profile, funding may come from Modulyz or from one of the funding partners we work with. We will tell you who is behind an offer before you sign anything.

Where a partner funds the transaction, that partner sets its own terms and makes its own credit decision. We are not responsible for a partner's decision, and we do not act as your financial, tax or legal adviser.

3. An application is not an offer

Submitting an enquiry or application starts a conversation. It does not create a commitment on either side, and nothing on this website is an offer of credit. Any financing depends on underwriting, verification of the information you provide, the asset or use of funds, and final approval and documentation.

We may decline an application, or withdraw or amend a quote before signing, including where verification does not match what was submitted.

4. Commercial purposes only

Everything we offer is for business and commercial use. It is not for personal, family or household purposes, and it is not consumer credit. Consumer protections that apply to personal loans, including certain federal disclosure requirements, do not apply to commercial financing.

Personal guarantees are common in this market and may be required as a condition of approval.

5. The information you give us

You agree that the information you submit is accurate and complete to the best of your knowledge, and that you will tell us if something material changes while your file is open. Underwriting rests on what you tell us, so inaccurate or incomplete information can delay a decision or invalidate an offer.

6. Rates, terms and figures shown

Any rates, payment amounts, terms, timelines or examples shown on this site are illustrations. They are there to give you a sense of how a structure works, not a quote. Your actual pricing depends on credit profile, time in business, revenue, the asset being financed, the term you choose and current market conditions.

Funding timelines are estimates based on typical files. Complete documentation moves faster; missing bank statements, titles or vendor invoices slow things down.

7. Credit authorisation

By submitting an application, you authorise Modulyz and our funding partners to obtain business and personal credit reports, bank data and other information needed to evaluate your request, and to do so again in connection with renewals, servicing or collection.

An initial review is normally a soft enquiry with no effect on your credit score. A hard enquiry may be needed at the offer stage, and we will let you know beforehand.

8. Electronic records and signatures

You agree to receive disclosures, notices and agreements from us electronically, and that an electronic signature has the same effect as a signature on paper. You can ask for a paper copy of anything you have signed with us, and you can withdraw your consent to electronic delivery, though doing so may mean we cannot continue with the application online.

To read what we send you, you will need a current browser, a working email address and the ability to save or print PDF files.

9. Testimonials and results

Customer comments on this site reflect the experience of those particular businesses. They are not a promise or a prediction of what will happen with your file, and approval amounts, pricing and turnaround times vary from one application to the next.

10. Acceptable use

When using this site, please do not:

• Submit false information, or apply on behalf of a business you are not authorised to represent.
• Attempt to access parts of the site or systems you have not been given access to.
• Scrape, copy or reuse the content in bulk, or use automated tools to submit forms.
• Interfere with the site's operation, or upload anything harmful.

We may suspend access or decline to work with anyone who does these things.

11. Content and trademarks

The text, design, graphics and code on this site belong to Modulyz or our licensors. You are welcome to view and share pages for your own business purposes. Reproducing the material commercially, or using the Modulyz name and logo, needs our written permission first.

12. Third-party sites and partners

The site may link to pages we do not control, and parts of the application process rely on third-party tools. We include them because they are useful, but we do not control their content or practices and are not responsible for them. Their own terms and privacy policies apply when you use them.

13. Disclaimer

The site and its content are provided as they are. We work to keep everything accurate and available, but we do not warrant that the site will be uninterrupted or error-free, or that the information on it is complete or current at any given moment. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing here is financial, tax, accounting or legal advice. Please speak to your own advisers before committing to a financing structure.

14. Limitation of liability

To the fullest extent permitted by law, Modulyz and its officers, employees and partners are not liable for indirect, incidental, special or consequential losses, including lost profits, lost business or lost data, arising from your use of this site or from an application that does not proceed.

Where liability cannot be excluded, it is limited to the amount you have paid us in fees in the twelve months before the claim, or one hundred dollars, whichever is greater. Some states do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnity

You agree to cover Modulyz against claims, losses and reasonable legal costs arising from information you submitted that turns out to be false or misleading, from your misuse of the site, or from your breach of these terms.

16. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute that we cannot resolve between ourselves will be handled by the state or federal courts located in San Francisco, California, and both sides agree to that jurisdiction.

Before starting anything formal, please contact us. Most problems turn out to be a misunderstanding that a phone call sorts out faster than lawyers do.

17. Changes to these terms

We may update these terms from time to time. The revision date at the top tells you when they last changed, and continuing to use the site after an update means you accept the current version. Terms in a signed agreement do not change because this page does.
